TERMS & CONDITIONS:

By submitting your information, you are agreeing to the following:

Deposit: 50% deposit is required to confirm your event. Your event is not confirmed until your deposit has been received. We frequently have two parties inquiring about the same date. We reserve the right to accept another event booking for any date(s) you have been in communication with us about without advance notice if you have not yet remitted a deposit.

Final Payment / Late Fees: Final balance is due the day service is provided, or by the due date stated on your invoice, whichever is later. Checks are not accepted for final payment without prior approval. A late payment fee may be added to any outstanding balance after the first 24 hours, or after the due date on your invoice, whichever is later, unless specific arrangements have been made with us.

Minors: Persons under the age of 18 will not be served at our bar(s). You may request a minor’s non-caffeinated bar for an additional fee.

Guest Count: We will provide a variety of beverages and enough supplies for the number of guests you indicate. Some beverages may be more popular than others and may be depleted. If your guest count is significantly higher than anticipated, an additional fee will be added to your final bill.

Refunds: Cleveland Espresso does not issue refunds for low turnout or unconsumed beverages.

Extended Time: Should you ask us to stay beyond the agreed time, an additional service fee will be applicable and payable at time of extension. We reserve the right to decline extended service.

You Cancel: All deposits are returned in full should you cancel at least 10 days prior to your event minus a $35 administrative fee. If you cancel less than 10 days prior to your event but at least 72 hours ahead of time, 50% of your deposit is forfeited. If you cancel less than 72 hours prior to your event date, your deposit is forfeited.

2nd Request for Your Date: If we receive a second request for the date you are holding, we may ask you to change your date for a discount off your balance due. You may choose to continue to hold the date or reschedule.

We Cancel: Cleveland Espresso reserves the right to terminate this contract should circumstances arise outside of our control, including staffing shortages, vehicle breakdown, equipment failure, or other issues outside of our control that prevent us from providing service. If Cleveland Espresso cancels, all deposits will be returned in full. (Some exceptions may apply – for example, if you requested a custom menu option that required items we do not normally keep in stock.)

Inclement Weather: In the event of inclement weather making it difficult to load and unload equipment and/or serve at the event venue, Cleveland Espresso reserves the right to suspend or cancel service. Late start due to inclement weather does not warrant a refund. If cancellation is necessary due to weather, all deposits/prepayments will be refunded minus $150. This amount will be applied to your future booking. Please watch the weather the days prior to your event for high winds, rain, or winter weather conditions, especially if your event is outside.

Parking / Unloading / Fees / Citations: Our driver must be able to park in a convenient location and allow enough time to unload without the risk of being ticketed or towed. Cleveland Espresso reserves the right to cancel service should parking be a issue for our driver.* Client will receive a refund of any prepaids minus 20%. If parking fees are incurred by our staff, these fees will be added to final bill, up to $20 per vehicle. Any citations issued to our driver(s) who followed your instructions for parking or load in/out will be billed back to the organization.

*If there is no parking available to us at the building entrance for load-in and load-out, it may be difficult or impossible for us to unload, delaying service or possibly restricting access to the venue altogether. Our driver has permission to depart if they cannot locate a safe place to park and unload.

Liability: You, the client, will not attempt to hold liable nor sue Cleveland Espresso LLC, and/or its umbrella company Latte Living LLC, The Coffee Catering Company LLC, nor its subsidiaries, owners, franchise owners, partners, employees, or independent contractors, for any losses, except where permitted by law due to negligence on the part of an individual. The Client will not hold Cleveland Espresso LLC and/or any of its sister companies, owners, officers, employees, or investors liable for negligence on the part of any individual(s). Nor will the Client sue or attempt to hold liable the same should any guests become ill or injured before, during, or after the event.

Unlawful Activities: The client and parties related to the client and event will comply with all the laws of the United States and the State of Ohio, all municipal ordinances and all lawful orders of police and fire departments, and will not do anything on the premises in violation of any laws, ordinances, rules or orders. Unlawful activity occurring on the premises is cause for immediate cancellation by Cleveland Espresso without refund to client.

If a portion of above is not legally contractual, the remainder shall remain in full force.

I have read and understand all the terms previously presented and agree to adhere by them and understand that I and/or my organization may forfeit monies, or incur a fee, for failing to abide by these terms.
